Terms of Service

Last updated October 12, 2026

These terms form the contract between you and Sommet when you create an account, start a trial or subscribe to a plan. Please read them carefully.

1. Who we are and what these terms cover

Sommet is operated by Geoffroy Stanger ("Sommet", "we", "us").

These terms apply to the website sommet.dev, the application app.sommet.dev, the Sommet API and the Sommet MCP server (together, the "Service"). They apply to any person or organisation that creates an account or subscribes to a plan ("you" or the "Customer").

You accept these terms when you create an account, and again when you subscribe to a plan. They prevail over any general terms of purchase of the Customer.

2. Professional use only

The Service is offered exclusively to professionals: companies, sole traders, freelancers, agencies and other organisations using it for the purposes of their trade, business, craft or profession. By creating an account, you confirm that you act in that capacity.

As a result, the provisions of the French Consumer Code that protect consumers, including the right of withdrawal, do not apply.

3. The Service

Sommet measures how AI assistants such as ChatGPT and Gemini answer the questions you track about your market, which sources they cite, and how your brand and competitors appear in those answers. It can also read the search data of the sites you connect (Google Search Console, Bing Webmaster Tools) and the visits of AI crawlers, and turns this evidence into recommendations.

Answers are collected from third-party AI systems whose behaviour changes over time and differs between users, places and moments. The measurements and recommendations of Sommet describe what was observed when they were collected. They are not a promise of any ranking, mention, citation, traffic or revenue.

Sommet commits to an obligation of means (obligation de moyens) to provide the Service with care and in line with the description published on sommet.dev at the time of your subscription. We may improve or change features, provided the essential features of your plan remain available during the period you paid for.

4. Your account

You must provide accurate information, verify your email address and keep your password and sign-in methods confidential. You are responsible for all activity under your account, including that of the team members you invite to your workspaces and of the AI assistants you connect through the MCP server.

Tell us without delay if you suspect any unauthorised access to your account.

5. Free trial

A free trial lets you try the Service on one domain for 7 days, within the limits shown on the pricing page. It starts once your email address is verified and your questions are ready. No payment card is required, and the trial ends automatically: nothing is charged unless you subscribe to a plan.

One trial is available per customer. We may refuse or end a trial that is used to circumvent this rule.

6. Plans, prices and payment

Paid plans are monthly subscriptions. Their features, limits and prices are those shown on sommet.dev/pricing when you subscribe. Prices are stated in euros. VAT is not applicable under article 293 B of the French General Tax Code (TVA non applicable, art. 293 B du CGI); should this change, VAT would be added at the applicable rate.

Subscriptions are paid in advance by card through our payment provider, Stripe, and renew automatically each month until cancelled. Invoices are available in the billing portal.

If a payment fails, Stripe retries it and access to the paid features is kept for a short grace period; it is then suspended until the amount is paid. In accordance with article L441-10 of the French Commercial Code, any amount not paid on its due date bears late payment interest at three times the French legal interest rate, together with a fixed indemnity of 40 euros for recovery costs.

7. Price changes

We may change our prices. Any change applies to an existing subscription only from the renewal that follows a notice sent by email at least 30 days in advance. If you do not accept the new price, you may cancel before it takes effect.

A subscription started at a launch price shown as such on sommet.dev/pricing keeps that price for as long as it stays active, including when the listed price rises. A cancelled subscription loses it.

8. Changing plan and cancelling

You can change plan or cancel at any time from the billing portal. A cancellation takes effect at the end of the paid period: you keep access until then and are not charged again. Periods already started are not refunded, except where the law requires otherwise, where the Service was unavailable through our fault, or under the first-month guarantee below.

First-month guarantee: if the first paid month of your first subscription does not surface at least one page of your site to improve, write to [email protected] within 14 days after that month ends and we refund it in full.

9. Your content and data

You keep all rights to the content you provide or connect: domains, brand names, competitors, questions, notes, and the data imported from the services you connect ("Customer Content"). You grant Sommet a non-exclusive licence to host, copy and process Customer Content for the sole purpose of providing the Service to you, for the duration of the contract.

You warrant that you have the right to provide Customer Content and to connect the sites and accounts you add to Sommet, in particular that you own or are authorised to manage the Google Search Console properties, Bing Webmaster Tools sites, Cloudflare zones and log drains you connect.

The reports and recommendations produced for you may be used freely for your business.

10. Acceptable use

You agree not to: use the Service for any unlawful purpose or in breach of the rights of others; access or attempt to access accounts or data that are not yours; circumvent the limits of your plan or the security of the Service; send automated requests at a volume that disrupts the Service; copy, resell or provide the Service to third parties as a standalone offering without our written agreement; or reverse engineer the Service, except to the extent permitted by law.

We may suspend access in case of a serious breach of this section, after notice unless urgency or the security of the Service requires immediate action.

11. Third-party services

The Service relies on third-party services, including AI assistants (ChatGPT, Gemini), data providers (DataForSEO), the APIs of the services you connect (Google, Microsoft Bing, Cloudflare, Vercel), OpenAI for analysis, Stripe for payments and Resend for emails. Their availability and terms are outside our control. When one of them changes, limits or interrupts its service, we will do our best to adapt the Service, but we cannot be held liable for that change.

When you connect an AI assistant to Sommet through the MCP server, that assistant receives access to your workspace data and, if you approve it, can change your tracked questions and recommended actions on your behalf. Its use of that data is governed by the terms of its provider.

12. Availability and support

We make reasonable efforts to keep the Service available at all times, but we do not guarantee uninterrupted availability. Access may be interrupted for maintenance, updates or reasons beyond our control. Support is provided by email at [email protected].

13. Intellectual property

The Service, its software, design, content and the Sommet name and logo are and remain the property of Sommet. For the duration of your subscription or trial, Sommet grants you a personal, non-exclusive and non-transferable right to use the Service for the needs of your business. No other right is granted.

14. Liability

Sommet is liable only for direct and foreseeable damage resulting from a breach of its obligations. Sommet is not liable for indirect damage, such as loss of profit, revenue, business, customers or reputation, nor for decisions you take based on the measurements and recommendations of the Service.

The total liability of Sommet under the contract, for all causes combined, is limited to the amounts you paid to Sommet in the 12 months preceding the event giving rise to liability.

These limitations do not apply in case of gross negligence or wilful misconduct, nor where the law prohibits them.

15. Personal data

Sommet processes the personal data of its customers and users as described in its Privacy Policy, available at sommet.dev/privacy.

Where Customer Content contains personal data, Sommet processes it on your behalf as a processor within the meaning of article 28 of the GDPR: only to provide the Service and on your documented instructions, which are these terms; under a duty of confidentiality; with appropriate security measures; through the sub-processors listed in the Privacy Policy, of whose changes you will be informed; assisting you with requests from data subjects and with your obligations; and deleting the data at the end of the contract, unless the law requires its retention.

16. Duration, suspension and termination

The contract starts when you create your account and lasts until your account is closed. You can close your account at any time by writing to [email protected]; any paid subscription must first be cancelled.

Sommet may terminate the contract in case of a serious breach of these terms that is not remedied within 15 days of a notice sent by email, or with 30 days' notice for any other reason; in the latter case, any period paid and not used is refunded.

After the contract ends, your account and Customer Content are deleted within 30 days, except the data we must keep to meet our legal obligations, such as invoices.

17. Force majeure

Neither party is liable for a failure caused by an event of force majeure within the meaning of article 1218 of the French Civil Code.

18. Changes to these terms

We may update these terms. We will inform you of any material change by email at least 30 days before it takes effect. If you do not accept it, you may cancel your subscription before that date; continuing to use the Service afterwards means you accept the updated terms.

19. Governing law and disputes

These terms are governed by French law. In case of a dispute, the parties will first try to reach an amicable solution. Failing an agreement within 30 days, the dispute will be brought before the competent courts of the place of the registered address of Sommet.

20. Contact

For any question about these terms, write to [email protected].
